Terms of Service
1. Acceptance of Terms
By downloading, installing, or using the You are Loved application (“App”) or accessing the related website at loved.cyberstudios.co.za (“Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App or Site. The App is provided by Cyber Studios (“we,” “us,” “our”).
2. Description of Service
You are Loved is a wellness application that provides:
- A personalized welcome using a first name you optionally provide (stored locally on your device).
- Gentle mood check-ins (e.g. “Doing my best,” “Okay,” “A bit low”) with kind follow-up phrases on your next visit.
- Daily affirmations (text from a third-party API and optional scenic imagery from Unsplash) to support emotional wellbeing.
- Options to share a message or “contact a friend” (using your device’s share functionality; we do not send messages for you).
The App is offered free of charge. We may add, change, or discontinue features with reasonable notice where practicable.
3. Disclaimer — Not Professional Advice
The App is for general wellness and encouragement only. It does not provide medical, psychological, therapeutic, or other professional advice. Affirmations and check-ins are not a substitute for diagnosis, treatment, or care from qualified health or mental health professionals. If you are in crisis or need professional support, please contact a healthcare provider or a crisis helpline in your country. We do not guarantee any particular outcome from using the App.
4. Intellectual Property
All content, design, branding, and technology in the App and Site (including but not limited to the name “You are Loved,” “Kindness Collective,” logos, and layout) are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission. You may use the App for personal, non-commercial use in accordance with these Terms.
5. Acceptable Use
You agree to use the App and Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use. You must not:
- Use the App to harass, abuse, or harm others.
- Attempt to reverse-engineer, decompile, or extract source code from the App.
- Introduce malware, spam, or automated scraping.
- Impersonate us or any third party.
We may suspend or terminate access if we reasonably believe you have breached these Terms.
6. Third-Party Data & Services
The App relies on third-party services whose own terms and policies apply:
- Affirmations (affirmations.dev) — We display random affirmations from this API. We do not control the content; use is subject to their terms.
- Unsplash (api.unsplash.com) — We may display images from Unsplash. Use is subject to Unsplash’s terms.
- App stores (Google Play, Apple App Store) — Download and use may be subject to the store’s terms.
We are not responsible for the availability, content, or conduct of these third parties.
7. Limitation of Liability
To the fullest extent permitted by applicable law (including the Consumer Protection Act 68 of 2008 in South Africa where applicable):
- The App and Site are provided “as is” and “as available.” We do not warrant that they will be uninterrupted, error-free, or free of harmful components.
- We exclude liability for indirect, incidental, special, or consequential damages (including loss of data, profit, or goodwill) arising from your use of the App or Site.
- Our total liability for any claim arising from or related to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months before the claim (or zero if the App was free).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (e.g. death or personal injury caused by negligence, or fraud).
8. Indemnification
You agree to indemnify and hold harmless Kindness Collective, Cyber Studios, and our directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or Site, your breach of these Terms, or your violation of any law or third-party rights.
9. Termination
You may stop using the App at any time. We may suspend or terminate your access to the App or Site if we believe you have breached these Terms or for operational or legal reasons. On termination, your right to use the App ceases. Provisions that by their nature should survive (including Sections 4, 7, 8, and 10) will survive termination.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of South Africa, save where mandatory consumer law in your country gives you the right to bring proceedings in your place of residence.
11. Changes to Terms
We may update these Terms from time to time. We will post the updated version on this page and update the “Effective date.” For material changes, we will provide notice in the App or by email where feasible. Continued use of the App after changes constitutes acceptance of the updated Terms.
